Updated: 7/15/23 My name is Jacqueline and I am humbly pleading for your help to keep my daughter and our home. 5 years ago I divorced my daughter's father to remove her from a toxic and abusive situation, he refused to seek treatment or change his behavior. I don't like to ask for help, but I have reached a point where I don't have any other option than to ask for help or sell my home to provide enough financing to keep my daughter. I have exhausted all of my assets and collateral as well as my fiance's, and would like to keep my daughter and I at our rural location near Battle Lake Minnesota with our handful of pets and homestead animals to provide her with a wholesome and authentic upbringing. I am currently fighting a nasty legal battle that started in January 2024 to retain custody of my ambitious, lively, and intelligent 8-year-old daughter because my ex suddenly says he doesn't want her homeschooled. He has done everything possible to break my fiance and I financially, and break me mentally and emotionally. We managed to get through the divorce and navigate the last 4 years with some conflict but without the need for legal intervention.... until he met someone who condones his bad habits and everything changed for the worse. His daughter, once again, became an afterthought, and he suddenly disagreed with everything we had previously agreed upon. One of which is homeschooling. I have 2 B.S. degrees from South Dakota State University, a broad range of life and work experiences, and am more than qualified to teach my daughter at home. My daughter has been receiving counseling due to his nasty tactics. This counselor has told him she is gifted, intelligent, socialized, and clearly educated, squashing any claim that she is not being educated. Despite my daughter pleading with him to let her stay with me on our acreage, on our little remote lake, with all of the animals and nature, learning from home, he insists on bringing her to his small farming town in South Dakota 4 hours from me to live with him fulltime and go to public school. I was forced out of my nursing job due to hostile management and an unsafe working environment for both staff and patients 2 years ago and have been working hard to get my own business off the ground and used my savings to do so. Because I don't have a town job and am trying to build my own business, my ex says that I am a bad moral example for our daughter. Adding to the difficulties, my fiance has suffered from 2 grand mal seizures due to toxic exposures, including arsenic from bad well water at a rental property he resided at for a number of years. Already operating his horse business from his parent's ranch, Kyle moved back to his parents until we could find a place together. Before his second seizure, we thought we had found a wonderful property that he could operate his growing horse business from. But when the property massively failed the inspection due to a hidden issue, they refused to repair the issue and kept our $14,000 downpayment despite returning our $5,000 earnest money. We have contract law and documentation on our side, but the lawyer fees are accumulating for our civil case. After the real estate deal went bad, Kyle had his second seizure. We finally found a doctor who found the root issue and is treating the source of the problem. Unfortunately this is not covered by insurance. I have needed specialty treatment for a neck injury from 2 different car accidents causing whiplash, one when I was a child and another in 2018, pinching my spinal cord near the base of my skull causing a long list of problems including excruciating headaches. This is also not covered by insurance and has required nearly weekly visits to the Minneapolis area for the last 7 months, where I finally found an effective treatment method and plan. I have improved greatly, but still require care while my body heals from decades of injury and am on restrictions per my doctor. My mother has also recently had a significant amount of health issues and required hospitalization, including the onset of dementia. I have been her main caregiver, assisting in shopping, medical visits, and care to allow her to stay in her apartment as long as possible. When it rains it pours! I am asking for a significant amount of money because of the amount of bills. Legal fees have already exceeded $10,000 for both the custody battle and the civil case to regain the $14,000 downpayment and show no signs of stopping. I am behind 3 months in my mortgage, have the monthly bills stacking up, loans are coming due, and I have run out of grace periods and deferment time.
