It began back in January when the Attorney General released an official opinion attempting to unilaterally declare certain low-THC hemp extract products as Schedule I substances under Indiana law. This official opinion was then used by local county prosecutors around the state to intimidate small business owners making a living off selling low-THC hemp extract products. Below is an excerpt of a letter one of our members received: If you have received a letter from your local prosecutor, please seek legal counsel and send a copy of the letter to us. To be clear, there has been no change in state law to warrant such an interpretation from the Attorney General. In fact, since 2018, state and local governments have been incentivizing low-THC hemp extract manufacturers to build and grow their businesses in the state. Unfortunately, the Attorney General’s goal is to turn farmers, small business owners and consumers into criminals overnight with no change in state law. Thanks to the leadership of MHC member 3Chi, we are pushing back against this government overreach. On June 26, we filed a complaint seeking a preliminary injunction to stop law enforcement from using the Attorney General’s opinion to prosecute participants in the robust low-THC hemp extract industry in the state. We anticipate a ruling towards the end of August to mid-September and will keep our members up to speed as the litigation progresses. This is a make or break moment for Indiana’s hemp industry.
