Hello everyone. Some of you may know my beautiful mother suffered an aortic dissection on the night of Thanksgiving 2024. She survived a 12-hour emergent surgery replacing a heart valve and her entire ascending aorta. Sadly though, she subsequently died on November 28, 2024. My mom has a will. In that will, she left me, her only child, a cabin. A place that she wanted her family to enjoy together. She poured her heart and soul into that property making it a home away from home. My mom had a small life insurance policy, which she had a loan against. She also had a small annuity from my dad. Together, those two items barely covered the cost to transport her from Georgia, where she died, to Florida where she is buried. Her spouse of 4 years has decided that he is going to sue her estate for his "elective share". Many of you may not know what this is. It means that despite a decedent's expressed wishes, a spouse can sue the estate, taking a percentage of the total value of the estate. The estate is not just property. It can be life insurance, bank accounts, annuities, valuables, etc. Each state has its own regulations (I highly encourage everyone to look this up). Additionally, any legal fees incurred from probate or other legal fees contesting the elective share is NOT deducted from the estate value. That means someone has to pay an attorney just to fight for their dead parents' wishes to be honored. ANYONE who knew my mother knew her wishes. Her spouse knew her wishes, he signed her will as a notary. In addition to this, her spouse has not paid a penny of the $20,000 dollars it took to bury her. Yet is asking for 30% of those funds received and used to bury her. This is embarrassing to me and my mother's memory to ask for help. But I need help. I have already spent almost $8000 of our own money in legal fees and it is far from over. I anticipate it costing upwards of $15,000 to defend and honor my mothers wishes. If you can donate to the cause, I would greatly appreciate it. If you can't, I ask that you please spread the word and pray that her wishes will be honored. Thank you.
